Job purpose

Implement and complete 100% of the assigned plan in each period.

Carrying out legal proceedings and judgment enforcement in compliance with the procedures, regulations and professional guidelines of the bank and the bank AMC and ensure maximum benefits for the bank.

Key accountabilities (1)

1. Directly performing legal proceedings to handle and recover debts:

• Directly work with customers, guarantors and related parties to find the fastest, most feasible and effective debt recovery plan.
• Assess the possibility of debt settlement and recovery by legal proceedings/receiving collateral to replace the debt repayment/debt deduction for submission to the competent authority for approval;
• Participating in the lawsuit process from the stage of preparing the lawsuit dossier, participating in the trial and receiving the court's judgments and decisions;
• To request judgment enforcement for debts for which a legally effective judgment/decision has been issued and to urge the organization of judgment enforcement by civil judgment enforcement agencies/ bailiffs' offices;
• Complete the procedures before, during and after the sale of collateral and coordinate with related units to implement the after-sale procedures.
• Coordinating with professional units of the bank to participate in solving criminal cases in accordance with regulations of the bank, the Company and the law.
• Proactively propose the Debt Management Center to give opinions on debt/mortgage settlement plans, problems arising in the process of debt settlement, and coordinate the implementation of the approved plan.
• Directly work with competent state agencies in the process of criminal justice (courts, procuracies, judgment enforcement, police agencies...);
• Establishing and maintaining relationships between the Company and other units in the system and with other relevant organizations (Courts, Procuracy, Police, Judgment Execution...).

2. Advise the competent authorities:

• Proactively propose process improvements to relevant units in order to bring the highest efficiency to Techcombank's debt settlement.
• Advising the Head of Department / Team Leader in the process of developing or coordinating with other units to develop draft documents related to debt collection activities in the whole system.

3. Other responsibilities:

• Update and report to the Competent Authority on the progress and results of the implementation of the debt settlement plan periodically/at the request of the Competent Authority.
• Other tasks assigned by Leader.
• Implement and participate in activities to build the company's organizational culture.

Success Profile - Qualification and experience

• Degree/Occupation: University graduate or higher, majoring in Law
• Experience: at least 07 years of experience in debt settlement or lawyer or court/procuracy/judgment enforcement
• Foreign language (English): According to Company's regulations from time to time
• Understanding of the legal system of Vietnam, especially the provisions of civil law, commercial business, finance and banking, legal regulations on civil procedure, criminal law provisions. , legal regulations on criminal procedures, legal provisions related to judgment enforcement activities...
• Knowledge of the system of judicial and executive agencies of Vietnam (Courts, Procuracy, Judgment Execution)
• Good understanding of the business of debt settlement
